Article 1: General

The terms and conditions (“Terms”) contained within this page relate to your rights and obligations in relation to this web site, located at hallmarkphotography.co.uk (“Site”) and any goods purchased through the site. Please read them carefully. You may have other rights granted by law and these Terms do not affect these. If there is anything you do not understand, then please contact us.

This site is operated by Hallmark Photography (referred herein as “us”, “we”, Hallmark Photography,  or “our”), located at The Pippin, Calne, Wilts, SN11 8JQ. You can telephone us on 01249 816707.

We reserve the right to amend these terms at any time without prior notice. Any changes will be posted to this page and will take effect immediately. By continuing to use the site you are bound by these terms.

Article 2: Privacy Policy

At Hallmark Photography we are dedicated to safeguarding and preserving your privacy when visiting our site or communicating electronically with us.

This Privacy Policy, together with our terms of use, provides an explanation as to what happens to any personal data that you provide to us, or that we collect from you.

We do update this Policy from time to time so please do review this Policy regularly.

For the purpose of the Data Protection Act 1998 our data controller is Kevin Hall.

In operating our website we may collect and process the following data about you:

  • i. Details of your visits to our website and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data.
  • ii. Information that you provide by filling in forms on our website, such as when you registered for information or make a purchase.
  • iii. Information provided to us when you communicate with us for any reason.

On occasion, we may gather information about your computer for our services and to provide statistical information regarding the use of our website to our advertisers.

Such information will not identify you personally it is statistical data about our visitors and their use of our site. This statistical data does not identify any personal details whatsoever.

Similarly to the above, we may gather information about your general internet use by using a cookie file. Where used, these cookies are downloaded to your computer automatically. This cookie file is stored on the hard drive of your computer as cookies contain information that is transferred to your computer’s hard drive. They help us to improve our website and the service that we provide to you.

All computers have the ability to decline cookies. This can be done by activating the setting on your browser which enables you to decline the cookies. Please note that should you choose to decline cookies, you may be unable to access particular parts of our website.

Our advertisers may also use cookies, over which we have no control. Such cookies (if used) would be downloaded once you click on advertisements on our website.

The information that we collect and store relating to you is primarily used to enable us to provide our services to you. In addition, we may use the information for the following purposes:

  • i. To provide you with information requested from us, relating to our products or services. To provide information on other products which we feel may be of interest to you, where you have consented to receive such information.
  • ii. To meet our contractual commitments to you.
  • iii. To notify you about any changes to our website, such as improvements or service/product changes, that may affect our service.

If you are an existing customer, we may contact you with information about goods and services similar to those which were the subject of a previous sale to you.

If you are a new customer, we will only contact you or allow third parties to contact you only when you have provided consent and only by those means you provided consent for.

If you do not want us to use your data for our or third parties you will have the opportunity to withhold your consent to this when you provide your details to us on the form on which we collect your data.

Please be advised that we do not reveal information about identifiable individuals to our advertisers but we may, on occasion, provide them with aggregate statistical information about our visitors.

We may transfer data that we collect from you to locations outside of the European Economic Area for processing and storing. Also, it may be processed by staff operating outside the European Economic Area who work for us or for one of our suppliers. For example, such staff maybe engaged in the processing and concluding of your order, the processing of your payment details and the provision of support services. We will take all reasonable steps to make sure that your data is treated securely and in agreement with this Privacy Policy.

Data that is provided to us is stored on our secure servers.

The transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically and transmission of such data is therefore entirely at your own risk. Where we have given you (or where you have chosen) a password so that you can access certain parts of our site, you are responsible for keeping this password confidential.

There may be occasion when we will disclose your personal information to third parties:

  • i. Where we sell any or all of our business and/or our assets to a third party.
  • ii. Where we are legally required to disclose your information.
  • iii. To assist fraud protection and minimise credit risk.

You mind find links to third party websites on our website. These websites should have their own privacy policies which you should check. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them.

GDPR gives you the right to access the information that we hold about you. Should you wish to receive details that we hold about you please contact us using the contact details below.

Article 6: Shopping with us

This site and the goods sold through it are subject to change without notice and we reserve the right to improve, alter or modify designs without prior notification. We will inform you of any changes to the advertised goods prior to the dispatch of such goods.

By submitting your order you are agreeing to buy the goods and allowing us to use your personal details for the purposes of supplying goods (including passing your details on to third party couriers).

We are not obligated to fulfill your order and supply your goods until we have confirmed that we have accepted your order and received payment in full. Your order will be deemed to have been completed when we dispatch to you the goods which form your order. We reserve the right to reject your order at any time.

The specification, sizes, images, descriptive content and advertising published by us or contained on our site are issued only for giving an approximate idea of the goods described in them and colours shown are intended as a guide only. They do not form part of the Terms. Actual colours may differ to your own monitor settings, over which we have no control.

All pricing is subject to change without notification. Any such changes will be effective immediately on publication to the site.

If your order is received damaged we will endeavour to put this right providing that any damage is reported to our office within 48 hours of delivery. Please be aware that this may require us asking for further information from either the delivery company or the client receiving the order, which may cause some delay. Please be assured that we will try to resolve any problems as quickly as possible.

Article 7: Gift vouchers

Hallmark  Studio Gift vouchers are valid for a stated period from the time of purchase.  Expiry dates will be shown on any voucher purchased. Vouchers may be used to purchase products and/or services from  Hallmark Photography.

Please note that vouchers bought through the Groupon voucher site have limited validity and are exempt from the normal T & Cs set out here.  It is the responsibility of the voucher purchaser to check the terms and conditions set out when purchasing a Groupon offer and Hallmark Photography will not be obliged to honour any vouchers beyond the expiry date stated.

Article 8: Pricing

All prices are the responsibility of Hallmark Photography. We reserve the right to change our prices without prior notice. All prices include VAT at the current rate. Any offers or promotions are run at our discretion and we reserve the right to amend or cancel offers or promotions at any time.

Article 9: Delivery

Orders will normally be delivered by Royal Mail unless otherwise stated when you place your order. Exact delivery dates and times are not provided – please see individual items for more information and dispatch details.

We cannot be held responsible for the actions of the delivery agents and any delays caused as a result, such as industrial action or unforeseen circumstances such as inclement weather.

Please note that once an item has left our premises, the delivery address cannot be changed. If a delivery cannot be made to the address given, for any reason, then arrangement for re-delivery must be made by our client directly with the delivery agent and not through our offices.

Article 10: Copyright

All copyright and intellectual property rights existing in our designs and products and in the content of this site remain the property of Hallmark Photography.

Article 11: Ordering with us

By ordering with us or using our website at www.hallmarkphotography.co.uk you are agreeing to our terms and conditions. Article 12:Refund Policy

The photographer will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. When an order is placed with us, the person attending the viewing of the images produced  and subsequently placing any order, assumes responsibility for that part of the process. No exception can be made as we cannot be held responsible for individual tastes or preferences. All personalised products are ordered as bespoke items and are therefore non-refundable.
